All vehicle rentals at Bingham are governed by a comprehensive Rental Agreement, which you will receive upon booking confirmation or vehicle pickup. This document outlines the specific terms, conditions, insurance coverage, applicable charges, and your obligations for the rental period. In case of any discrepancies between these Terms and the Rental Agreement, the Rental Agreement will prevail.
Eligibility Criteria
Vehicle Rental Requirements
- To hire a vehicle from Bingham, you must be at least 21 years old, noting that age restrictions can vary by vehicle type, and there may be extra charges for drivers under 25. You must possess a valid driving licence suitable for the vehicle category, held for the specified duration in the Rental Agreement. Valid identification and proof of your current address are required, along with payment information and a security deposit. Any additional criteria outlined in the Rental Agreement must also be met.
Booking and Payment Process
- You can make reservations via our website, by phone, or directly at our Dartford office. A deposit may be necessary to confirm your booking. The total payment, along with a security deposit, is generally required upon vehicle pickup. All prices are listed in British Pounds (£) and include VAT if applicable. We accept major credit and debit cards through secure payment systems.
Vehicle Pickup and Drop-off
- At the time of collection, it is important to conduct a thorough inspection of the vehicle and report any existing damage right away. A vehicle condition report will be generated and must be signed. The vehicle should be returned in the same condition as it was collected, taking into account normal wear and tear. Any new damage will be evaluated and may result in additional charges. Please return the vehicle with the same fuel level as received; failure to do so will incur refueling fees. Late returns may attract extra charges, so please inform us in advance if you expect a delay. You will be accountable for any parking tickets, traffic violations, or fees incurred during your rental, along with an administration fee.
Insurance and Liability Terms
- All rentals come with basic third-party insurance included. Full coverage specifics and excess amounts can be found in the Rental Agreement. Optional insurance packages may be offered to lessen your financial liability. It is advisable to examine these options thoroughly. You remain liable for damage or loss up to the insurance excess, except when additional insurance is purchased. Damage resulting from negligence, misuse, or violation of these Terms falls under your responsibility, irrespective of any insurance coverage.
Cancellation and Modifications
Cancellation and amendment policies differ based on the type of booking and the notice period provided. For precise information, please consult your booking confirmation or Rental Agreement. Be aware that late cancellations or no-shows could incur additional charges.
7. Restricted Activities
Prohibited Vehicle Uses
- The vehicle must not be used for any illegal activities, including racing, rallying, or off-roading. It is prohibited to transport hazardous materials or to sublet the vehicle to others. Unauthorized drivers are not permitted, and driving under the influence of alcohol or drugs is strictly forbidden. The vehicle should only be used for its intended purposes and within specified passenger and weight limits. Operating outside designated geographical boundaries without prior approval is not allowed.
Breach of these terms may lead to rental termination and extra fees.
Liability Limitations
To the fullest extent allowed by English and Welsh law, Bingham Car Hire will not be responsible for any indirect, incidental, or special damages, including loss of profits, data, or business resulting from your use of our services. Our total liability for any claim is capped at the rental amount you paid in the last 12 months. This limitation does not apply to liability for death or personal injury resulting from negligence or fraud.
9. Applicable Law
These Terms are regulated by the laws of England and Wales. Any disputes will fall under the exclusive jurisdiction of the English and Welsh courts.
10. Updates to Terms
Bingham reserves the right to update these Terms at any time. Changes will take effect immediately when posted on our website. Continued use of our services indicates your acceptance of the revised Terms.
